Actor Ray Winstone has claimed there was an “outrageous miscarriage of justice” after an innocent man served seven years in jail for a murder that he did not commit.

Sam Hallam, 24, was found guilty of murdering Essayas Kassahun in 2005 but has now been freed by the court of appeal.

Winstone, the uncle of one Hallam’s friend, spoke outside after the judgment was delivered: “So why did an innocent man serve seven years?

“For me it is the disgraceful, unprofessional action of the police involved in this case. Action that has caused a terrible stress within the family of the Hallams.”

The Scum star added that his conviction had torn apart the Hallam family, leading Terry Hallam, Sam’s father, to commit suicide. He was found hanged in October 2010.

In a statement, Winstone said that Hallam, of Hoxton, north London, was in fact nowhere near the scene of the crime, was not captured on CCTV and there was no evidence to say he was the killer.

    Like us on Facebook

“Someone must answer for this outrageous miscarriage of justice,” the actor said.

“A young man lost his life. His family will never get over that.

“The killer is out there because the police involved in this case did not do their job.

Sam Hallam who has had his conviction for murder quashed after seven years in jail has exclusively told ITV London Tonight he is “still in shock but Im just so happy to be home.” His mother has said “a lot of people let him down.

Sam Hallam told London Tonight how he felt after being released from prison yesterday. The 24 year-old spent seven and half years in jail for a murder he did commit.

See more of this exclusive interview on London Tonight at 6pm and ITV News at 6.30.

Paul May, who ran the release campaign for Hallam’s family, read out a statement on Sam Hallam’s behalf shorty after his murder conviction was quashed.

In an interview with the BBC, Mr Hallam said that everything was unfair.

The whole system, the whole police process, the court process. Obviously it was not fair. Everything was not right.

The original police investigation was not done properly. They could have done things then to eliminate me but they never…

…It was horrible. I had to get used to it. I couldn’t do anything. It was only, it was only my supporters and family who could help.

Sam Hallam, who spent more than seven years behind bars for a murder he insists he did not commit, said after his conviction was quashed by High Court judges today:

“I don’t want anyone else ever to suffer what I’ve been through.”

    Wednesday, May 16, 2012

SOMETIME in 1989, a man was reportedly executed in Texas for murder. He was arrested because he fit the description of the killer by the eyewitness. Many years later, a report came out that said that he was the wrong man.

Law professor James Liebman said that despite a range of signs that he was not a guilty man, Carlos DeLuna was sentenced to death for a crime he did not commit and executed based only on eyewitness accounts.

Have something to report? Tell us in text, photos or videos.

This story, which came out in this daily yesterday, drew my attention because of the wife of a man who was arrested in our mountain barangay for the killing of a woman barangay councilor. The wife showed up in our house early last Sunday accompanied by a distant relative. She claimed that her husband was arrested as suspect in the killing of the barangay councilwoman, who was also their distant relative.

The police later told me that the husband, named Ponciano Artis, was just invited to the police station as a suspect along with his son. But later on, Ponciano was booked because his right arm was positive of powder burns. His son was suspected as accessory.

The wife was vehement about her husband being innocent, adding that almost everyone in their barangay, including close relatives of the victim, could not believe he was guilty. She said her husband does not even know how to hold a gun. The problem was that the real suspect was the one who pointed her husband to the police as the killer.

And he has become the witness of the police, although a member of the arresting team told me that they are reconsidering his status. In the meantime, Ponciano and son are languishing in the municipal jail on the strength of a positive paraffin test. But could not a wrong sample be submitted to the police laboratory?

The wife and her daughter came back Monday after visiting her husband in the municipal jail. I suggested to them to go back to their mountain barangay and gather affidavits taken before the barangay captain from those who say her husband was in the middle of the dance floor dancing when the killing occurred. She pointed to several persons she said are willing to testify to the innocence of Ponciano, who was always a peaceful man and whom she claimed has never been seen with a gun.

But when she came back to the house this morning, she looked crestfallen. Apparently, their friends, kin and neighbors who openly say Ponciano is innocent are willing to say so, but are not about to swear to it as Gods truth. I asked her why, and she said they are afraid for their life. They know the real killer is free, and still with them.

A woman who falsely claimed she was speeding because she had suffered a miscarriage has been refused leave to lodge a late appeal against her conviction.

The woman was caught driving at 87 kilometres per hour in a 70km/h zone along Airport Drive in Brisbane’s northeast on August 19, 2010.

When asked why she was speeding, she told the police officer she had her period and needed to get to the airport quickly to change her white pants.

    Advertisement: Story continues below

The woman challenged the ticket in the Brisbane Magistrates Court last year, claiming the defence of extraordinary emergency.

She told the court she thought she had actually miscarried while driving to the airport to go on a holiday to Hamilton Island.

She said she did not tell the police officer about this as she had not yet told her husband, who was in the car, that she was pregnant.

The magistrate did not believe her story and fined her $310.

She applied to the District Court in Brisbane late last year for an extension of time to lodge her appeal.

However, Judge Brad Farr this week refused the application saying he was in “complete agreement” with the magistrate’s guilty verdict.

The Steps singer said that the surrogate mother had lost the child that he and partner Craig Ryder were going to raise.

He described hearing the news as the “worst moment” of his life.

“We were thinking of names, and we even planned our first Christmas as a family. We were both ready to be dads,” he told The People.

“I just feel really empty and helpless. The only person who can help me is Craig.”

Watkins said that his Steps bandmates were very supportive during their recent reunion concerts, and had all visited him when they heard the news.

He added: “The way I try to look at it is that there’s another little star in the sky. It just wasn’t meant to be for us at this time.”

The pair had come through a lengthy adoption process, and eventually decided to turn to surrogacy.

Watkins and West End star Ryder have been together for nearly five years.

Steps reunited for a new Sky Living series On the Road Again to follow the pop group on their comeback tour earlier this year.

        Source: valawyersweekly.com

      From Your Tango.com

      ByChristina Farrell

The size of my jeans used to determine my self-esteem. The shape of my body represented my deepest insecurities. A taut tummy signified my need for approval, while a muffin top indicated Id been drowning my sorrows with food. For years, my fluctuating weight determined my self-worth. Hypocritically, Id tout a different message. Beautyis not defined by a dress size, Id say, exalting the splendor of women in all shapes and sizes. Somehow, I was unable to see beauty in myself.

Then, last year, a week after Mothers Day, I finally figured out what authentic beauty was. OnMay 16th, 2011,I gave birth to and subsequently lost my daughter during my fifth month ofpregnancy. During my pregnancy, I gleefully packed on 30 pounds, feeling plump and beautiful. My extraordinary weight gain became a thing of humor. I called myself the clumsy walrus on a daily basis.

For the first time in my life, the weight gain represented something wonderful. My wobbly bits and jiggly parts were bursting with mommy-to-be pride. Yes, I had the prized pregnancy glow. And yet, the day after I lost Mia, my newly round body symbolized loss. I was trapped in a larger body that was a constant reminder of the emptiness that surrounded me. What was once 30 pounds of pregnancy jubilation was now a daily memento of grief.

COURT APPEAL: Directors of failed Lombard Finance say they have been the victims of a miscarriage of justice.

The directors of failed Lombard Finance and Investments say they have been the victims of a miscarriage of justice and that the verdicts against them for making false statements in offer documents were wrong in law or fact.

Lombard chairman Sir Douglas Graham, along with fellow former justice minister Bill Jeffries, Lawrence Bryant and Michael Reeves, were found guilty of making misleading statements in documents seeking money from the public between December 2007 and April 2008, when Lombard was put into receivership, owing $111 million to about 3600 unsecured investors.

Reeves, who was Lombard’s founder and chief executive, said in his notice to appeal that Justice Robert Dobson’s interpretation of section 58 of the Securities Act had set the threshold of liability for directors too low.

That had led to the act being applied in “such a way as to criminalise directors who discharge their fundamental duty to act honestly, responsibly, prudently and in good faith”.

Reeves said the grounds for his appeal were similar to those of the other directors.

Justice Dobson also failed “to have any, or any sufficient regard to what is now recognised to have been the tumultuous and extraordinary financial environment in which the offer documents were compiled and subsequently distributed”, Reeves said.

Reeves said while Justice Dobson agreed that the directors had acted honestly and without intent to mislead investors they were guilty of a “material misjudgement”.

During sentencing Justice Dobson said the men’s decision not to disclose growing pressure on Lombard’s cashflow was not one they could reasonably have come to.

Reeves said Justice Dobson also relied on calculations relating to Lombard Finance’s liquidity position by the Financial Market’s Authority’s lead investigator, which were produced by the Crown during cross-examination after the Crown had closed its case.

Comment on this post to win a copy of In the Company of Angels: A Memorial Book on Mother’s Day (US holiday, May 13.)

This book is designed just like a traditional baby book, but it is meant for our babies who did not live to be born, or who died very shortly after birth. Unlike the traditional baby milestones we will never see, this book has gentle prompts asking about our hopes and dreams for baby, the moment you found out you were pregnant, and the days you were carrying the baby. It also has a section for the sadder moments, when you found out the baby was lost, and places for memorials and anniversaries.

The book is especially designed so that if you do not have sonograms or pictures, you can tug those pages out, so no page in your baby’s book is blank.

So many things out in the world are there just to help Baby Loss Moms. I’m always amazed by the talent and love that so many mothers put into their art. Some highlights

Sculpture by D. Antonia Truesdale.

Angel Lullabies by Amy Robbins-Wilson.

And of course for Give Away #1, the poems by Nicole Breit. Did you comment to try and win a copy? GO!

I watch over all these things, and last year, added my own book to the mix, Baby Dust.

So today’s give away will be a copy of Baby Dust. The winner can get a paperback copy or the ebook for an ereader.

The book follows five women on their pregnancy loss journeys.

Melinda is 35 and has two step children, but lost her first baby in the first trimester.

Dot is 27 and discovered at 20 weeks that her baby had no brain.

Tina is 17 and went into labor at 19 weeks. Her baby lived for 40 minutes.

Janet is 32 and ended up with a molar pregnancy, which can become invasive cancer.

Stella is 44 and had 2 first trimester losses and multiple failed IVF. She never had children.

Comment to win a copy! I will probably give away several. I have to empty out this closet before I start trying again myself at the ripe age of 42!

The book trailer features the stories of several women from around the world. Double click to see it larger.

I know this week is bittersweet for many of us. You’re here because at least one of your sweet babies didn’t make it into your arms.

Mother’s Day is forever a mixed blessing for me. My first one, just two weeks after losing Casey at 20 weeks gestation, was so terrible I have blotted it from my memory. And even now, 14 years later, I still feel the pull of emotions in both directions as I think of the babies I lost (Casey, Daniel, Emma) and the ones that I got to keep (Emily, Elizabeth), and now, the one we’re trying for (our friends call him Thor even though he doesn’t exist yet…)

I want each of you to remember that whether that baby is in your belly, in your arms, or in the sky—you’re still a mother. It doesn’t matter who recognizes it or who doesn’t—your baby most certainly does.

I’m kicking off a week of give aways! You can comment here or on the Facebook page for chances to win! Feel free to comment both places—I’ll be giving away items both here and at A Place for Our Angels.

The first give away is a new book of poetry about infertility, pregnancy, and loss that came out just a few weeks ago by Nicole Breit, called “I Can Make Life.” This collection was a finalist in the Mary Ballard Poetry Chapbook Prize this year.

Check it out below, or if that’s too small on your browser, click through to check it out bigger here!

All the mothers who win any of the give aways over the next few days will be notified on Mother’s Day this Sunday (if I remember! If not, on Monday.)

SHE had been super-excited about the arrival of her third child.

She said: “I went for my first scan – my 12-week scan – at a private clinic in Harley Street a week ago and there was no heartbeat.”

“I was given three options; I could have an operation, I could wait for it to happen naturally or I could take a tablet. I took a tablet,” she continued.

Asked if she was scared it had something to do with boozing early in her pregnancy, Nic said: “Yes, I did worry.”

“But it was only one night and I didn’t know I was pregnant,” she added.

Former Celebrity Big Brother contestant Nicola McLean has suffered a miscarriage.

The star, who announced that she was expecting her third child with husband Tom Williams last month, revealed that she received the devastating news when she went to see her doctor for a 12 week scan.

Recalling the moment she was told that she had suffered a miscarriage, the Mirror reports Nicola saying:

“There was no heartbeat. The doctor told me that the baby’s heart probably stopped at nine weeks. We are absolutely gutted but weve just got to be grateful that we have two healthy boys. Its the first time its happened so Ive got to think of the positives.

Worried that her drunken night out last month (before finding out that she was pregnant) could have been to blame, Nicola added:

“I did worry [about her evening of boozing], but it was only one night and I didnt know I was pregnant.

Having been reassured by the doctor that her baby “was never going to grow or form properly”, Nicola explained: “Its called a chromosome abnormality. Its pretty common the baby was never going to grow or form properly. Although he said theres a high chance that my next baby could be perfectly fine.”

Revealing that she would love to have a daughter, the Mail Online reports Nicola saying:

“I’d love a girl but I’d also be happy with a boy because I love going to the football. But I would love all the ballet and tutus. I love children, I love being a mum and having a big family.”

The 30-year-old beauty – who was expecting her third child with husband Tom Williams – admits she is upset to have lost the baby, but is thankful to have two healthy sons with Rocky, six, and two-year-old Stryker.

She said: ”I went for my first scan – my 12 week scan – at a private clinic in Harley Street a week ago and there was no heartbeat. The doctor told me that the baby’s heart probably stopped at nine weeks.

Nicola – who is best known for appearing on reality TV shows ‘I’m a Celebrity … Get Me Out of Here’ and ‘Celebrity Big Brother’ – is worried it may have been a night of drunkenness when she did not know she was pregnant which caused the miscarriage.

Discussing the night out, she told OK! magazine: ”Was I scared? Yes. I did worry but it was only one night and I didn’t know I was pregnant. I looked really drunk in the pictures that were published but that was because I was on Prozac, not for depression but to control my bulimia, but after two glasses of champagne I get really drunk because you can’t mix them.”

Sometimes when women arrive at my Facebook group for those currently going through a loss, they ask, “How long until I get over this?”

All I can say is, “Fourteen years and counting.”

One of the hard things about losing a baby that no one else felt, or saw, or touched is that everyone wants you to get over it quickly. They don’t have the same emotional investment. Pregnancy, with its sleepiness and dream-like quality, encourages the visions of the baby to come, the moments ahead. It’s how you get through the hard stuff—throwing up, bone-tiredness, caution and fear. So we’re wired to already see and experience this baby well beyond the sensations in our belly.

In her book Virgin Blue (which has lots of miscarriage and pregnancy trauma within it), author Tracy Chavalier’s characters, both midwives, talk about how the pregnant mother is always ”listening” inside her. She’s distracted, taken out of the outside world, and focused on what is happening within.

It really doesn’t matter when the conversation stops, the day after the positive pregnancy test or during the birth, when some tragedy takes the baby during its final journey to the outside. It’s still a cutting off, a silencing of a relationship that had become the focus of your life.

Fourteen years ago today, I didn’t realize my connection had been cut. I suspected—but then every pregnant mother seems to always have some fear—but until the Doppler was silent, until the doctor was rushed in and the sonogram machine powered up, until he moved and moved and moved the paddle, trying to find an elusive heartbeat for a 20-week baby who should have filled the screen with movement and sound, but didn’t. Until I had proof; I hadn’t known.

April 28 taught me how to listen, how to hear, how to know when the conversation ceased. My next two losses were no surprise. I had learned the difference between the hum that reverberates between a mother and an unborn child and the silence that means the child is gone.

And this year, at 42, I am getting married again and, next month, taking that journey one more time. I don’t even know if the conversation will start. I may not be able to get pregnant at all. The chromosomes in my eggs may be too sticky to divide properly and get the baby on its journey. But I will listen, and I will hear. And whatever conversation I might get, however many days or weeks or months I may get to feel that hum, I will take them.

One thing I’ve learned in 14 years—I am not afraid. I hope, for all of you, who may be finding this page for the first time or the fourth, that you find that courage too.

There are concerns real and hypothetical that must be addressed by the Government through the proposed law, pending before Parliament, on surrogacy.

    April 25, 2012:

Brigham Young, leader of the Mormon Church in Utah now a State of the US must be turning in his grave to find infertile Americans and Europeans, among others, flocking to India to seek solace from Indian women.

In The Twenty-seventh Wife by Irving Wallace, he has gone on record to say that the justification for Mormonism, allowing a male to take 27 wives simultaneously, in an act of polygamy or plural marriage, was pure economics simultaneous conception of so many women at the same time that adds immensely to population to work on farms and other places. He then went on to say why he, therefore, did not favour its reverse, polyandry.

The elevation to the surrogate capital of the world must be soothing to the Indian ego (compared with the belittling and distinctly uncomfortable appellation of being the diabetes capital of the world). But there are concerns real and hypothetical that must be addressed by the Indian government through the proposed law, pending before Parliament, on surrogacy.

There is considerable quibbling on the nature of the Indian law-in-the-making would it be altruistic surrogacy or commercial surrogacy that would be promoted and countenanced?

Altruistic surrogacy is perhaps an oxymoron in the context of regulatory measures, given that no law is really needed if surrogacy were to be confined to altruistic purposes.

That foreigners are flocking India, especially Anand, the place which is also home to Amul that spearheaded the White Revolution, is a telling commentary on the economic and commercial aspects of surrogacy in India cost has been the raison d’etre for India’s broader leadership on the medical tourism front, of which surrogacy tourism is obviously a subset.

The merits and demerits of surrogate motherhood have been discussed many times over. This article seeks to examine only those aspects that have not received the kind of attention they should have.

There is a view that one need not be unduly worried about the health aspects of surrogacy inasmuch as the egg and sperm are those of the biological parents, with the surrogate mother only gestating the child.

        STORY HIGHLIGHTS

(CNN) — A nurse accused of killing a Texas mother in a parking lot and stealing her 3-day-old son had suffered a miscarriage and believed she needed to show her fiance that she had a child, authorities said Wednesday.

A judge refused to allow bond for Verna McClain, 30, a mother of three children.

McClain told her fiance “she was pregnant and had given birth to a child, by him,” said Montgomery County Sheriff’s Capt. Bruce Zenor. “She represented this (the abducted baby) as her child.”

Witnesses said Kala Golden, 28, who was shot outside a Houston-area pediatrician’s office Tuesday, screamed and attempted to chase after the car with her son inside, CNN affiliate KTRK reported.

The car struck Golden as it left the scene, the station said. She died later at a hospital. Authorities said she had several gunshot wounds to the torso.

McClain is accused of killing Golden and taking 3-day-old Keegan Schuchardt. She was arrested just before midnight Tuesday, according to an arrest report.

She is charged with capital murder, Montgomery County District Attorney Brett Ligon told reporters.

Zenor indicated the attack on Golden was random. A handgun has been recovered, officials said.

Verna McClain appears before a Texas judge on Thursday while being accused of killing a mother and stealing her newborn baby. NBC’s Chris Clackum reports.

By msnbc.com staff and news services

Updated at 4:30 p.m. ET: MONTGOMERY COUNTY, Texas — Texas nurse Verna McClain, charged with capital murder in the shooting death of a mother and the snatching of her 3-day-old baby, made her first court appearance Thursday morning, NBC station KPRC reported.

Asked by a judge if she understood the capital murder charge against her, McClain, 30, quietly replied: “Yes, sir.”

McClainwas assigned an attorney and ordered held without bail, KPRC said. A bail hearing is scheduled Monday.

McClain is accused of shooting Kala Marie Golden Schuchardt, 28, numerous times in the chest and kidnapping Keegan Schuchardt Tuesday outside a Montgomery County pediatrician’s office about 20 miles north of Houston.

Savannah Leyde likens her daughter’s birth to a rainbow after a storm.

Five years ago, Leyde and her husband lost their son, Taylor, to stillbirth. It was a month before his due date.

Soon afterward, she and her husband learned they were expecting once again. They fought through grief, anxiety, fear and other emotions until JennaLee was born. It was the one-year anniversary of Taylor’s funeral.

“God planted a rose,” Leyde said. “And I shed humongous tears of joy.”

Through research, Leyde learned a high number of women who lose a baby through miscarriage or stillbirth become pregnant within the first year.

So she wanted to offer her support in what can be a difficult time.

    On March 3, 2009, the two-year anniversary

Savannah Leyde of South St. Paul founded Taylored To You, a nonprofit that helps couples who have lost a child and are now expecting again. (Pioneer Press: Scott Takushi)

Taylored to You, which they run out of her South St. Paul home, has been growing since. It now provides free maternity portraits, birth announcements and other resources to parents who have lost a child within the past three years and are pregnant for the first time following the death.

    She considers them “kindred spirits.”
